These Customer Terms set forth the terms and conditions for the sale of products to customers through the marketplace owned and/or operated by OMAN TECH or any of OMAN TECH's companies. These Customer Terms, together with the Site Terms of Use, Privacy Notice, Cookie Notice, and any additional terms decided by OMAN TECH as updated or amended by OMAN TECH from time to time, constitute the agreement of sale entered into with the customer.
The terms used in this Agreement have the meanings assigned to them in the Definitions section of the Customer Terms. In the event of any conflict between the documents comprising this Agreement, these Customer Terms shall take precedence, followed by the Website Terms of Use, the Privacy Notice, and the Cookie Policy.
1.1By placing a purchase order through the marketplace, the customer agrees to be bound by the Agreement. It is strongly recommended that you review the Agreement before placing any purchase order through the marketplace, and the customer is solely responsible for doing so. In addition, OMAN TECH reserves the right to change the terms of the Agreement at any time. Any such changes will take effect upon posting through the Marketplace.
2.1When placing an order, the customer must create an account on the Marketplace. For further information regarding account creation, the customer should refer to the Site's Terms of Use. OMAN TECH reserves the right to cancel any order and close any account if the customer breaches the account creation terms set forth in the Site's Terms of Use.
3.1Products offered through the Marketplace are sold either by OMAN TECH or by the sellers as identified in the product description. Products sold by sellers may be subject to different terms in addition to those specified in the agreement. It is the customer's responsibility to check these different terms before placing an order for those products.
1.2 The customer agrees to pay the full price of the product as specified in the product description at the time the purchase order is received in the marketplace, plus any installation, shipping, or other charges that may apply to the purchase order. While OMAN TECH endeavors to ensure that product prices are accurate at all times, errors may occur. In the event that an error is discovered in the pricing of the Products, OMAN TECH will, in its sole discretion, (1) notify the Customer as soon as possible and give the Customer the option of reconfirming the order at the correct price, canceling the order, or (2) canceling the order and immediately refunding the price if the price has already been paid by the Customer. The Customer acknowledges that this is the Customer's only recourse in the event of a pricing error.
2.2 All prices are stated in ريال and do not include taxes (if applicable), shipping, or installation charges unless otherwise expressly stated in the Agreement.
3.2 Once a purchase order has been successfully submitted and accepted on the Marketplace, the Customer will receive a purchase order confirmation via email detailing the purchase order details. The Customer acknowledges that OMAN TECH may not retain all purchase order data, and therefore it is recommended that the Customer retain the purchase order data and the order confirmation email.
4.2 The risk of loss or damage to the Products passes to the Customer upon the first delivery attempt to the Customer's address as specified in the Purchase Order. OMAN TECH or the seller (as applicable) remains owner of the products until the product price has been paid and received in full. OMAN TECH reserves the right to cancel a purchase order at any time prior to shipment.
1.3 The market offers several payment methods, such as paying via Visa, Mastercard, or Apple Pay, depending on your preference. The payment method for the purchase order appears at the final stage before the order is submitted.
2.3 In the case of card payments, whether at the time of placing the purchase order or receiving it, the customer is deemed to have authorized OMAN TECH or the third-party payment processor to process and validate the card information for the order amount upon placing the purchase order. To ensure that the card has not been used without the customer's consent and to verify the validity of the card and the accuracy of the customer's information, the marketplace will direct the customer to the payment gateway page, which will ask the customer to enter their card information as required by the payment gateway operator. Furthermore, the payment gateway operator may validate the card information, as well as other information provided by the customer, by comparing it with the payment gateway operator's database.
3.3 The responsibility for verifying the customer's information and card, as well as correctly authorizing the debit transaction from the card, lies with the relevant payment gateway operator and/or the card-issuing bank, in accordance with their terms and conditions. OMAN TECH does not bear any liability for any losses or damages resulting from fraudulent transactions executed as a result of attacks on or breaches of any payment gateway operator, attacks or breaches of issuing banks, or as a result of malicious persons or persons other than the legitimate cardholders obtaining the customer's card information, PIN verification information, password verification information, or any other data authorizing purchases on the payment gateway.
1.4 For products sold by OMAN TECH, OMAN TECH may, at its sole discretion, prior to launching a new product, allow pre-orders by account holders for that new product. The price of the product subject to the pre-order must be paid in full when the pre-order is placed.
2.4 In addition to these Customer Terms, a Pre-Order may be subject to additional terms. If there is any discrepancy between these Customer Terms and the additional terms, the additional terms shall prevail unless otherwise stated.
3.4 The official launch date for the Pre-Ordered Product will be shown in the Product Description and may also be published in the Marketplace. Regular delivery times will begin once the Pre-Ordered Product is available.
4.4 Online discount offers that are in place prior to the release date of the product subject to the pre-order are not valid for the product subject to the pre-order. Online discount offers are not valid for pre-orders where the pre-order release date does not coincide with the offer.
5.4 OMAN TECH reserves the right to change the release date at its discretion, without any liability to customers. Furthermore, OMAN TECH reserves the right to cancel all pre-orders without any legal liability to customers except for a refund of the amount paid in accordance with the refund terms.
1.5 For products sold by OMAN TECH, OMAN TECH may, at its sole discretion, offer an Easy Installments option. The customer acknowledges and agrees that the Easy Installments prices shown in the product listing are approximate prices and are subject to change based on several factors, such as the customer's credit standing, credit history, and credit information network regulations.
2.5 Furthermore, the Customer acknowledges and agrees that the availability, pricing, installment amounts, and Customer eligibility for Easy Installments are subject to additional terms and conditions provided to Customers to conclude the Easy Installments sale. In the event of any discrepancy between the Customers' terms and the additional terms, the additional terms shall prevail unless otherwise specified.
1.6 For products sold by OMAN TECH, OMAN TECH may, at its sole discretion, offer a trade-in option. The customer acknowledges and agrees that the trade-in calculation offered in the marketplace is an approximate calculation and is subject to change due to several factors, such as the actual condition of the product used.
2.6 Furthermore, the Customer acknowledges and agrees that the provision, calculation, and eligibility for the Swap are subject to additional terms and conditions provided to Customers to enter into the Swap Transaction. In the event of any discrepancy between the Customers' terms and the Additional Terms, the Additional Terms shall prevail unless otherwise specified.
1.7 From time to time, as part of promotional activities offered by OMAN TECH, OMAN TECH may, at its sole discretion, issue discount coupons to customers who have accounts on the marketplace. Only the account holder may benefit from these discount coupons, and/or apply sales or promotions to all or some of the products sold by OMAN TECH through the marketplace. Discount coupons, sales, or promotional offers may be subject to additional terms that apply beyond those set forth in these Customer Terms. In the event of any discrepancy between these Customer Terms and the additional terms, the additional offers shall apply unless otherwise specified by OMAN TECH.
2.7 Unless otherwise specified in writing, discount coupons may only be used for products sold by OMAN TECH on the Marketplace. Furthermore, discount coupons are valid during the promotional periods for which they are issued, as specified in their terms.
3.7 Discount coupons may not be partially used, double-used, or redeemed for shopping credit. Only one discount coupon may be used per order. However, a single discount coupon may be used for multiple product purchases.
7.4 OMAN TECH reserves the right to disable, suspend, or exclude the use of any or all discount coupons for special promotions it offers on the marketplace from time to time without prior notice.
1.8 All products sold by OMAN TECH are subject to a minimum one (1) year manufacturer's warranty. The customer acknowledges and agrees that OMAN TECH's liability under the warranty is limited only to the repair or replacement of the product, at OMAN TECH's discretion as appropriate. The following terms apply to the warranties for all products sold by OMAN TECH:
2.8 In addition, for products sold by OMAN TECH, OMAN TECH may offer customers the option to purchase an extended warranty program subject to a separate set of terms. The extended warranty does not cover labor, transportation, or consumables, which are borne by the customer.
3.8 Customer acknowledges and agrees that the cost of any repair to the products after the expiration of the warranty period will be charged. In addition, any repair service provided outside of the warranty period is subject to a further one-month warranty period after the product is returned to the customer (or the first attempt to return it to the customer), for the same defect for which the product was repaired.
4.8 The invoice value is amortized based on the following rates:
5.8 The following events or items are excluded from warranty coverage for LCD monitors, plasma TVs, DLP projectors, and DLP TVs:
6.8 All products for which OMAN TECH acts as a distributor or agent and which OMAN TECH sells may be replaced with new products if one of OMAN TECH's service centers is unable to repair them within the warranty period. This failure must be documented in a technical report from OMAN TECH. If the same model is not available, the customer may choose another model based on the products available from OMAN TECH, and must pay the difference in price, if any.
1.9 This clause (9) applies to products sold by OMAN TECH or/and sold by sellers, but delivered by OMAN TECH. Delivery terms imposed by sellers apply in any other case. OMAN TECH undertakes to make reasonable efforts to contact the customer prior to delivery to schedule delivery. The account-owning customer must pay the price and receive the purchase order. They are also obligated to provide proof of identity when requested by the party designated by OMAN TECH to complete delivery.
2.9 If the customer is not present at the delivery address specified in the purchase order, the purchase order will be returned to OMAN TECH's warehouse, and the customer must contact OMAN TECH's customer service to schedule a new delivery date. If the customer does not contact customer service within a reasonable time period specified by OMAN TECH to reschedule delivery, the order will be deemed void.
3.9 The customer acknowledges and agrees that the accuracy of the delivery time depends on the accuracy of the delivery address details provided by the customer. OMAN TECH is committed to delivering the purchased products as soon as possible after the order confirmation time.
4.9 The customer is given the opportunity to review, change, update, or add to the delivery address details each time they place an order.
5.9 While OMAN TECH will make reasonable efforts to deliver purchase orders within the estimated and preferred delivery times, OMAN TECH shall not be liable for any delay or failure to deliver purchase orders within the estimated or preferred delivery times.
6.9 The delivery schedule and charges for purchase orders vary depending on the delivery area, seasons, products, and delivery options selected at the time of sale. The items below are for illustrative purposes only:
A delivery fee of 1.26 ريال will be charged, which is non-refundable if delivery details are incorrect or the customer cannot be reached via the contact number provided.
Delivery based on the 3-hour express delivery schedule cannot be rescheduled. If rescheduling is necessary, please contact OMAN TECH's Customer Service Center at 55027878 and your order will be postponed to the regular delivery schedule.
A delivery fee of 1.89 ريال will apply. This fee is non-refundable if delivery details are incorrect or the customer cannot be reached using the contact number provided.
Deliveries made under the One-Hour Express Delivery cannot be rescheduled. If rescheduling is necessary, please contact the OMAN TECH Customer Service Center at 55027878 and the order will be rescheduled to the usual delivery schedule.
7.9 The order may only be delivered within and must be signed upon receipt by the account holder or their representative, who must be 21 years of age or older. The customer must ensure that the correct delivery address is provided to enable us to deliver the order quickly and on time to the customer. The address must include the governorate name, block number, street number, building number, and the name and contact number of the responsible person, at a minimum.
8.9 If there is a change in the delivery address or time after order confirmation, the customer must contact OMAN TECH's Customer Service Center by clicking here.
9.9 The customer will be notified of the delivery status and time. OMAN TECH is committed to attempting to contact the customer before scheduling a delivery appointment to provide information about delivery times. Excite also undertakes to make reasonable efforts to honor the customer's preferred delivery times and dates. However, the customer acknowledges and agrees that these times and dates are for guidance purposes, as the actual delivery time may vary due to various potential delays beyond its control.
10.9 In the absence of the customer, delivery will be deemed successful if a family member or cleaner residing at the same address as the customer signs the invoice/delivery note. Products will be deemed delivered in good condition when the delivery note is accepted by the customer or their representative.
11.9 Products purchased but not requested for delivery or not delivered due to the customer's absence will be sold one (1) month after the purchase date. In this case, OMAN TECH is obligated to refund the invoice value to the customer after deducting 20%.
1.10 This clause (10) applies only to products sold by OMAN TECH. OMAN TECH's installation team must conduct a quality inspection in the customer's presence. If the customer wishes to keep the product unpackaged and install it on a later day, the customer bears responsibility for the safety of the unpackaged product and may not subsequently claim damage to the product or any missing parts (as applicable).
2.10 The terms below apply to the installation of air conditioners:
3.10 The OMAN TECH installation team will not drill into glass, ceilings, or aluminum partitions for safety and maintenance reasons.
4.10 OMAN TECH currently does not offer any installation services for water heaters.
5.10 TVs (5 KD installation fee applies for 32-inch to 43-inch TVs).
1.11 For products sold by OMAN TECH, OMAN TECH is committed to providing its customers with high-quality products. However, there are instances when a customer needs to exchange or return products, and such returns or exchanges will only be accepted if they are made as described below:
2.11 All product sizes and measurements are approximate. Sometimes product specifications may change from the manufacturer, or we may encounter a problem supplying certain products. We may offer an alternative of equal or better quality at the same price. If the customer is not satisfied with the replacement or exchange, they may return or exchange these products in accordance with the terms and conditions contained in this Customer Terms and Conditions document.
3.11 OMAN TECH may refuse to return or exchange any products sold after applying a discount or under promotional sales. OMAN TECH reserves the right to refuse to accept returns or exchanges of certain products, even if they comply with the above rules, if they come into contact with the skin or are considered sensitive, such as digital cards, electronic games, CDs, computer software, printer ink, toys, personal care products, watches, food, cosmetics, and underwear, or in accordance with applicable laws. Notwithstanding the foregoing, OMAN TECH may agree to replace these products in the event of manufacturing defects or non-conformity to specifications under applicable laws.
4.11 The Customer acknowledges and agrees that refunds will be made to the same method of payment for the purchase order, otherwise the Customer may be offered the option to receive gift vouchers. For card refunds, the refund process may take up to 4-6 weeks, subject to the payment gateway operator's policy.
5.11 For products sold by sellers, most sellers offer a 14-day return policy from the date of delivery confirmation. Some products have different policies or requirements associated with them. The customer is responsible for verifying the return conditions applicable to each seller. In all cases, products sold by sellers must be returned by picking them up at the customer's address only. OMAN TECH will not accept any of these returns in its showrooms.
6.11 Items sold by sellers are not eligible for exchange. Unless the return is processed by OMAN TECH, returns of any seller's products will be sent to the seller instead of OMAN TECH. After the carrier receives the product, it may take the seller up to one week to receive and process the return. It may take up to two weeks for cross-border orders. After the return is processed, it may take 5 to 7 business days for the refund to appear on the customer's payment card statement.
1.12 Certain terms of the Agreement (as defined herein) may not apply, in whole or in part, to the sale of Products sold by Sellers. Customer acknowledges and agrees that Sellers are independent third parties not owned or controlled by OMAN TECH, and that any purchase transaction made by Customer regarding Sellers' products constitutes an agreement between Customer and Seller subject to the terms and conditions of the Sellers as set forth in the Product Description and governed by the current Customer Terms of Use (as applicable).
2.12 The steps for placing a purchase order with a Seller are the same as placing any other purchase order for products sold by OMAN TECH. Customer must add items to their shopping cart and complete their order through the checkout process at OMAN TECH. Payment for order processing from Sellers is made immediately. OMAN TECH will transfer the invoice amount to the seller. Therefore, if the seller requests payment information or requests the invoice amount to be transferred directly to the seller, the customer must refrain from placing the order and contact OMAN TECH immediately.
3.12The product listing contains information about the party responsible for delivering the purchase order. If the purchase order is not delivered by OMAN TECH, it will be delivered directly by the seller.
4.12 A customer may cancel any purchase order submitted to a seller from the customer's account before the purchase order is shipped from the warehouse/store location. To request a cancellation, you must select the relevant purchase order from your orders and choose to cancel the items. No cancellations will be accepted once the purchase order has been shipped.
5.12 Sellers are obligated to ensure that stock is available for delivery. However, occasionally, an item listed may not be available at the time the purchase order is placed. If the seller is unable to deliver the purchase order, the seller is obligated to refund the customer until the customer can place a new purchase order.
6.12 Sellers set their own prices for the products they sell in the marketplace. Prices for similar or identical products may vary from seller to seller.
1.13 To the fullest extent permitted by law, OMAN TECH and OMAN TECH disclaim and exclude all warranties and representations, whether express, implied, or statutory, regarding the marketplace, products, delivery and installation services, or regarding the accuracy, currency, or completeness of the information provided by OMAN TECH, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement of a patent, trademark, or other intellectual property. The customer expressly agrees that the use of the marketplace and the purchase of the products is at their sole risk.
2.13 Customer undertakes to defend, indemnify, and hold harmless OMAN TECH, its Service Providers, and Vendors, and their respective officers, employees, and agents from and against any and all liabilities, costs, damages, injuries, claims, suits, judgments, causes of action, and expenses (including, but not limited to, attorneys' fees, court costs, and out-of-pocket expenses) incurred or suffered by any of them, including, but not limited to, third-party claims, as a result of any harm or damage arising out of or resulting from Customer's misuse of the Marketplace or Account.
3.13 In no event shall OMAN TECH be liable to the Customer for any incidental, indirect, consequential, punitive, or special damages, loss of revenue or profits, or any other claim (whether caused by the negligence of the Service, its agents, authorized dealers, or otherwise), or any incidental or consequential liability, including those arising from or in connection with any damaged or defective parts. OMAN TECH's aggregate liability arising from or in connection with all claims under the Agreement shall, at any time, not exceed the value of the product giving rise to the claim.
1.14 Customer acknowledges and agrees not to resell or export any purchased Products to any country or person subject to embargoes under the export control laws and regulations of the United States, the European Union, and/or the United Kingdom. Customer acknowledges and agrees not to use Products purchased from the marketplace in activities related to the design, development, production, or use of nuclear weapons or weapons of mass destruction. Customer agrees not to sell, lease, or transfer the Product(s) to end users engaged in such activities, and bears responsibility for any such activity. OMAN TECH assumes no responsibility whatsoever and provides no warranty, support, or service with respect to any product exported/used in violation of this provision.
2.14 OMAN TECH may, in its sole discretion, change the terms of the Agreement at any time. No waiver of any term or condition or of any breach of the Agreement shall be deemed a continuing or waiver of any other term or condition or of any subsequent breach of the Agreement. All rights and remedies, whether granted under the Agreement, by any other instrument, or by law, are cumulative and may be exercised singly or in combination.
3.14The Customer may not assign the Agreement or any of its rights or obligations without the prior written consent of OMAN TECH. OMAN TECH may assign or delegate to any third party as it deems appropriate. Furthermore, OMAN TECH may assign the Agreement, in part or in whole, to any third party.
4.14 The Agreement shall be governed by and construed in accordance with the laws of the State of عمان. All disputes arising under or in connection with this Agreement shall be resolved amicably through discussion between the parties. If the parties fail to reach an amicable solution, they agree to submit the disputed matter for final and exclusive resolution to the competent courts in the State of عمان.
